They commonly succeed; they are never a promise your ticket will win, and which apply depends entirely on your specific notice and location.
- Keeper-liability paperworkTo hold the registered keeper liable rather than the named driver, an operator must follow strict notice rules under the Protection of Freedoms Act 2012 — the right wording and information, sent within set time windows. When the paperwork misses them, keeper liability can fall away.
- Unclear or missing signageA private charge rests on a contract, and that only exists if the terms were displayed clearly — legible, well-lit and prominent. Signs that are hidden, contradictory or too small can undermine the whole basis of the charge.
- Grace periodsCodes of practice require a reasonable period to read the signs and decide, and after any paid or free time ends. Tickets issued inside those windows are open to challenge.
- Landowner authorityThe operator must actually have authority from the landowner to issue and enforce charges at that site. When challenged, that authority sometimes can't be properly evidenced.
Windscreen ticket or a letter? Two notices, two clocks
This is the single thing people most often get wrong, and it can decide the case:
- A windscreen ticket (a "Notice to Driver") is the notice left on the car at the time.
- A postal "Notice to Keeper" arrives in the post days or weeks later, addressed to the registered keeper.
Some operators do one, some the other, some both. The deadlines and the keeper-liability rules run from the notice itself — so which one you got, and its date, is often the whole argument.
